**ماده 538 قانون مجازات اسلامی

در تعدد جنایات، اصل بر تعدد دیات و عدم تداخل آنها است مگر مواردی که در این قانون خلاف آن مقرر شده است.

**ماده 537 قانون مجازات اسلامی

در کلیه موارد مذکور در این فصل هرگاه جنایت منحصراً مستند به عمد و یا تقصیر مجنیٌ علیه باشد ضمان ثابت نیست. در مواردی که اصل جنایت مستند به عمد یا تقصیر مرتکب باشد لکن سرایت آن مستند به عمد یا تقصیر مجنیٌ علیه باشد مرتکب نسبت به مورد سرایت ضامن نیست.

Article 537 of the Islamic Penal Code

In all the cases mentioned in this chapter, if the crime is documented exclusively with intent or the fault of the perpetrator, there is no guarantee. **ماده 522 قانون مجازات اسلامی:

متصرف هر حیوانی که از احتمال حمله آن آگاه است باید آن را حفظ نماید و اگر در اثر تقصیر او، حیوان مزبور به دیگری صدمه وارد سازد، ضامن است. ولی اگر از احتمال حمله حیوان آگاه نبوده و عدم آگاهی ناشی از تقصیر او نباشد، ضامن نیست.
تبصره 1- نگهداری حیوانی که شخص توانایی حفظ آن را ندارد، تقصیر محسوب می شود.
تبصره 2- نگهداری هر وسیله یا شیء خطرناکی که دیگران را در معرض آسیب قرار دهد و شخص قادر به حفظ و جلوگیری از آسیب رسانی آن نباشد، مشمول حکم تبصره (۱) این ماده است.

Article 522 of the Islamic Penal Code:

The owner of any animal who is aware of the possibility of its attack must protect it, and if due to his fault, the said animal harms another, he is the guarantor. But if he is not aware of the possibility of an animal attack and the lack of awareness is not due to his fault, he is not a guarantor.
Note 1- Keeping an animal that a person does not have the ability to keep is considered a fault.
Note 2- The keeping of any dangerous device or object that exposes others to harm and a person is unable to protect and prevent it from causing harm is subject to the provisions of Note (1) of this article**

**ماده 521 قانون مجازات اسلامی:

هرگاه شخصی در ملک خود یا مکان مجاز دیگری، آتشی روشن کند و بداند که به جایی سرایت نمی کند و غالباً نیز سرایت نکند لکن اتفاقاً به جایی دیگر سرایت نماید و موجب خسارت و صدمه گردد ضمان ثابت نیست و در غیر این صورت ضامن است.

Article 521 of the Islamic Penal Code:

If a person lights a fire in his property or another authorized place and knows that it will not spread anywhere, and often it will not spread, but by chance it spreads to another place and causes damage, the guarantee is not fixed and otherwise it is a guarantor.**

**ماده 400 قانون مجازات اسلامی

اگر رعایت تساوی در طول و عرض و عمق جنایت، ممکن نباشد و قصاص به مقدار کمتر ممکن باشد مجنیٌ علیه می تواند به قصاص کمتر، اکتفاء کند و مابه التفاوت را ارش مطالبه نماید و یا با رضایت جانی دیه جنایت را بگیرد.
