Regarding his statement, ["Tawheed is the key to the dawah of the Messengers.."]:

Hadith:
In another narration he ﷺ said until they make Allah One.." this is a part of a hadith in the sahihayn.

[It is the first matter through which the individual enters Islam.. "]:

The prophet ﷺ said,

لقنوا موتاكم: "لا إله إلا الله‏"‏

Exhort your dying men to recite: 'La ilaha illallah' (There is no true god except Allah)."

Likewise, in another hadith, when Abu Talib was on his deathbed, he ﷺ said,
"O my uncle! Say: None has the right to be worshipped except Allah, an expression I will defend your case with, before Allah."

So the dying person is urged to say laa ilaha illallah, and likewise it is the way to enter Islam. Laa ilaha illallāh Muhammad ar-Rasulullah, this is the religion of Islam sealed with the Shar'iah of Muhammad ﷺ.

So there is no Islam after he was sent, except the deen of the Shar'iah that he ﷺ bought. And there is no tawheed in Allah or another way to enter Islam except by the Shahadah that Muhammad is the rasul of Allah. And the Islam of one is not correct with the mere saying of laa ilaha illlallah, while refusing the shahadah Muhammad ar-Rasulullah. The one who does this is a kafir mushrik who follows his desires.

We pause here and next lecture we discuss the details of the categories of tawheed, Rububiyya, Uluhiyya and asma wa sifat.

Hukm also comes to mean ijtihad, which is when a scholar makes ijtihad, as the Prophet ﷺ said in a hadith in the Sahihyan,

"‏إذا حكم الحاكم، فاجتهد، ثم أصاب، فله أجران، وإن حكم واجتهد، فأخطأ، فله أجر‏"‏ ‏

I heard the Messenger of Allah (ﷺ) saying, "When a judge utilizes his skill of judgement and comes to a right decision, he will have a double reward, but when he uses his judgement and commits a mistake, he will have a single reward."

And hakim here includes rulers and leaders, and also includes scholars who passes judgment because a scholar passes a judgment in masāil that pertain to the Shariah of Allah عز وجل. Hence, the hakim may be used in reference to a scholar, based on the fact that he makes ijtihad, which only a scholar of knowledge does. So an alim is called a hakim because he passes a judgment in masāil, based on the Shar'iah of Allah, or based on what he views is in accordance to the Shar'iah of Allah عز وجل.

And Allah عز وجل called ilm/knowledge hukm, as in the statement of Allah,

{رَبِّ هَبْ لِى حُكْمًۭا وَأَلْحِقْنِى بِٱلصَّـٰلِحِينَ}

Hukm here means ilm, so a alim is a hakim in masail that conform with the deen of Allah according to his knowledge.

These are some of the meanings of "hukm", but when it was in reference to Allah عز وجل, it means tashree', like in the statement of Allah,

إِنِ ٱلْحُكْمُ إِلَّا لِلَّهِ ۚ أَمَرَ أَلَّا تَعْبُدُوٓا۟ إِلَّآ إِيَّاهُ ۚ ذَٰلِكَ ٱلدِّينُ ٱلْقَيِّمُ

{Legislation is not but for Allāh. He has commanded that you worship not except Him. That is the correct religion..}

This means that the right to legislate for the people is the sole right of Allah عز وجل. And he commanded that they only worship Him Alone, whereby they obey His shariah alone, which He legislated, and not to obey other Shari’ahs legislated by others besides Him, by obeying (false) equals, partners and tawagheet from mankind and Jinn.

Regarding his statement: ["Whoever seeks judgment from other than Allah has taken him as a Rab"]:
It is most correct to say, "Whoever derives legislation from others besides Allah (has taken him as a Lord). This is because tahakum/to seek judgement is from the actions of the servant, which will be mentioned in the section of tawheed al-Uluhiyyah. So whoever seeks judgement in others besides Allah has made shrik in Uluhiyyah. As for what relates here, it is that whoever gives the right of legislation to others besides Allah has committed shrik in Rububiyyah. Whoever gives the right to someone else in order to legislate laws that contradict the Shar'iah of Allah عز وجل , and to legislate matters that only Allah has the right to legislate, like setting punishments, setting halal and haram, wajibāt and mustahabaat etc, is a mushrik in Rububiyyah. None has a right to legislate in these matters. So they make a form of legislation, which is a ruling over the people with what contradicts the Shari’ah of Allah, in matters only Allah has the sole right to legislate.

With regards to legislation in the field of administrative matters to follow, and school vacations, like the beginning and end of yearly study terms, etc, these are matters that pertain to administrative management, this falls under the statement of the Messenger of Allah when he said, "You have better knowledge (i.e., of a technical skill) in the affairs of the world."

But to legislate in matters that only Allah has the right to do so, like making matters halal and haram and wajibat, etc and likewise that which relates to punishments and setting limits, and also what pertains to permissible or impermissible types of worship, etc, is from giving the right of legislation to others besides Allah and us from Shirk al-Rububiyya.

Whoever allowed others besides Allah to legislate for him and to legislate a way for the people to follow has indeed taken him as a Lord besides Allah.

What is the crime of these tawagheet?

They present themselves as rivals, and contest Allah's right, and elect legislators besides Him, and legislate laws for the people to follow. They legislate laws that relate to punishments, criminal laws and personal status laws, and legislate rules for politics, rulings and economy.

Hence, they legislated laws from themselves and obliged the people to follow them by force, so they enslaved the people to obey them willingly or unwillingly, and made themselves tawagheet who are worshipped besides Him, and contested Allah's right of hukm and legislation, when it is Allah who legislates as He wants. (Like Allah says):

{إِنَّ ٱللَّهَ يَحْكُمُ مَا يُرِيدُ..}

{Indeed Allah commands what He wills.}

{وَٱللَّهُ يَحْكُمُ لَا مُعَقِّبَ لِحُكْمِهِۦ ۚ وَهُوَ سَرِيعُ ٱلْحِسَابِ.}

{And Allāh decides; there is none to put back His decision. And He is swift in account.}

So these people came and contested Allah's right, in what pertains to His Rububiyya over His creation. And from His right of Rububiyya over His creation is to legislate and to rule for them however He Wills, and to rule them with what He Wills. So they contested Allah in this.

Therefore, tawheed al hakimiyya here in what relates to tashree'/legislation, in reality pertains to Rububiyyah because tashree'/legislation and hukm are from the siffat of Rububiyyah. This is because Tashree' /to legislate is an action from the actions exclusively specific to Allah. To legislate a shariah/way for the people to follow in all aspects of their lives is exclusively for Allah..for indeed shirk is to give an exclusive right of Allah to a creation. It is to set others besides Allah as equals with Him..this is exactly what shrik is, as the kuffar will say in Hellfire,

{قَالُوا۟ وَهُمْ فِيهَا يَخْتَصِمُونَ. تَٱللَّهِ إِن كُنَّا لَفِى ضَلَـٰلٍۢ مُّبِينٍ. إِذْ نُسَوِّيكُم بِرَبِّ ٱلْعَـٰلَمِينَ.

{They will say while they dispute therein. "By Allāh, we were indeed in manifest error. When we made you equal to the Lord of all worlds."} [26:96-98]

So they addressed their tawagheet and equals in Hellfire and explained that they were upon misguidance when they set them as equals with Allah.

How did they make them as equals?

It was by giving a right of Allah to a creation, otherwise the creation can never really be an equal with Allah, no matter what they do. The fact that these mushrikeen worshippers of the tawagheet gave a right which solely belongs to Allah, and gave it to the creation, by doing this, they made them partners and equals. And these tawagheet from the Jinn and Mankind were pleased with what was given to them from the rights of Allah.

This is the relation of tawheed al Hakimiyya with al-Rububiyya, in that hukm and legislation, and the right to legislate a way for the people to follow is from the rights of Allah alone, and is from His management of matters for the heavens and earth.

Now he explains that with regards to those who said tawheed al-hakimiyyya is a separate category, it still remains a part of tawheed al-Rububiyya, Uluhiyya and Asma wa Sifat.

Tashree': which is to legislate a shariah/way for the people to follow in matters of their lives, by which they derive permissible and impermissible matters, and what they must and must not do, what is wajib and what is mustahab/recommended, and prohibited etc.

But who is the one who has the sole right to legislate this for the people?

It is Allah Alone Who has no partner, because He is the One Who created them. So He has the right to set the amr and nahi for them, i.e., and what is permissible and what is prohibited. (Like Alah says):

الا له الخلق والأمر

{To Him belong the creation and the command;}

{ثُمَّ جَعَلْنَـٰكَ عَلَىٰ شَرِيعَةٍۢ مِّنَ ٱلْأَمْرِ فَٱتَّبِعْهَا وَلَا تَتَّبِعْ أَهْوَآءَ ٱلَّذِينَ لَا يَعْلَمُونَ.}

{Then We put you, [O Muḥammad], on an ordained way concerning the matter [of religion]; so follow it and do not follow the inclinations of those who do not know.} [45:18]

So the One Who Created the creation سبحانه وتعالى, especially the mukallafeen from the jinn and mankind, He is the only One Who has the right to legislate a Shariah for them to follow in all aspects of their lives, in all what concerns their politics, economics, worship, what is permissible for them and what is prohibited for them, in all aspects of their lives. Allah سبحانه وتعالى is the Only One who and the right to set and legislate for them laws to follow.

Note: *This time we have decided to post the complete commentary/explanation provided by Abu Bara As-Sayf from the audio as a transcript and have avoided paraphrasing as much as we were able to. We hope by doing so in this manner, we are able to cater for students of knowledge of different levels and abilities. Hence, those who are fluent in the Arabic language are able to follow along with the audios as well as those who are slightly weaker. Also, those students who need detailed  explanation and prefer to take as much notes are able to as well as those who prefer to note the main points only.

Remember to be sincere when seeking this knowledge, seeking it for Allah, hoping it be a light for you in both worlds, removing by it the darkness of ignorance, and so that you worship your Lord with insight. Whatever  you find of good is from Allah Alone and His Grace, and whatever you find of error is from myself and the Shaytan, and we seek Allah's protection. We ask Allah to accept this humble effort, to guide us and guide through us. Ameen.*
