Indian Telegraph Act, 1885
It governs the use of wired and wireless telegraphy, telephones, teletype, radio
communications and digital data communications.
It gives the Government of India exclusive jurisdiction and privileges for establishing, maintaining, operating, licensing and oversight of all forms of wired and wireless communications within Indian territory.
It also authorizes government law enforcement agencies to monitor/intercept
communications and TAP PHONE lines under conditions defined within the Indian
Constitution.
Section 5(2) of the act allows central and state governments to prevent the
transmission of messaging during a PUBLIC EMERGENCY or in the Interest of Public Safety, or in the interests of the sovereignty and integrity of India or the security of the state”.
Sanction for Interception: The abovementioned Supreme Court‟s observations
formed the basis of introducing Rule 419A in the Telegraph Rules in 2007 and later
in the rules prescribed under the IT Act in 2009.
Rule 419A states that a Secretary to the Government of India (not below the rank of a Joint Secretary) in the Ministry of Home Affairs can pass
orders of interception in the case of Centre, and similar provisions exist at
the state level.
Checks against Misuse
Interception remain in force not exceeding 60 days Copy is to be forwarded to a review committee within seven working days
Committee is expected to meet at least once in two months
Records shall be destroyed every six months
