Judge Martin Nolan has ruled consultant Pawan Rajpal be allowed to continue private practice despite a sexual assault charge. He has also said the surgeon should "be allowed to go back to Cavan General Hospital and interact with, not only the complainant in the sexual assault allegation (a co-worker), but also the potential witnesses."

To put that another way #JudgeNolan desires that the surgeon be allowed to speak to his alleged victim, as well as relevant witnesses in an ongoing investigation.

What a wonderful justice (and indeed health) system.

Interestingly, only last month Taoiseach
@SimonHarrisTD
praised immigration as being responsible for a supposedly amazing healthcare system when he visited Co Mayo on an patronising ice-cream photo op farce (employing the old 99 cross class unifier trick).

Harris (when he was Minister for Health) was once pictured with Mr. Rajpal and the accused said at the time "for the most part, the Irish Healthcare System is letting itself in for needless bad press”
Indeed.

As does the justice system, Judge Nolan being a case in point.

#JudgeNolan has also allowed Mr. Rajpal access to the "Clinical Indemnity Scheme", which would allow him to work in Limerick, or anywhere else private where he can access work stating, ‘This will ensure that his skill sets are maintained pending the trial [in the high court].

Judge Nolan said Mr Rajpal has worked in Cavan General Hospital for more than 20 years as though this is somehow an endorsement of good character and competency, seeming to imply he is not a risk to patients despite HSE chief

saying that two previous reports on the Consultant had marked him out as 'an immediate and serious risk to the safety, health and welfare of patients or staff’.

The concerns in question related to two patients. One of whom died of sepsis and another whom had a cancerous tumour missed by the consultant.

Mr Gloster wrote to Mr.Rajpal requesting he take leave and raising concerns regarding over 30 issues pertaining to the consultant’s "performance, capability, competence and conduct." Mr.Rajpal denies all allegations levied toward him.

Judge Nolan noted that Mr Rajpal's bail conditions required that [as a flight risk] the consultant is not allowed to leave Ireland... except to visit his parents in Pakistan (as though Pakistan is not thousands of miles away).

Mr Rajpal has admitted he was not upfront about the sexual assault criminal charge to the HSE, and despite noting Rajpal's lack of disclosure, he felt the consultant is trustworthy enough to be alone with patients. Which is even more unimaginable given he is a colorectal doctor that routinely examines intimate parts of patients bodies.

Last month Judge Nolan allowed a Department of Justice (irony) employee Niall Colgan to walk free from court saying it would be "unjust for this man to go to prison" citing a lack of aggravating factors. He allowed a second man Gavin Belmont to walk free also. Despite both men being convicted for possession of images of children being raped.

It would appear Judge Nolan may believe using such images for deviant sexual pleasure is a victimless crime, and it's a certainty he will continue to allow paedophiles and predators to walk free.

To date no judge in Ireland has ever been removed (using Article 35.4... “stated misbehaviour or incapacity”) despite that the Oireactas has the power to do so.

On the same Co. Mayo trip last month Simon Harris said it would be wrong of him to interfere in the work of the courts. However the fact is he can do so, and if ever there was a judge who has shown an unwillingness to do his judicial duty it is Judge Nolan.

So why has the government not sought to have him removed? (Following which the President could finalise any such resolution).
