Access to Information is An Urgent Need in Africa
From the national government to the county and regional rulings, the role of transparency cannot be overemphasized. It is the cornerstone for sustainable growth and inclusive development in every country.
However, in regions where access to information is still a luxury, transparency only remains better on paper than in action. And that has been the case with most African countries.

Out of the 55 African nations, 29 have already passed laws on access to information. Yet, studies show that even with the information laws in place, many have not put effort and resources into their systematic implementation, limiting the potential benefits for citizens and governments. Many of the laws have not been implemented. Yet, AFIC’s experience has proven that when implemented, access to information laws help citizens make informed participation in government policies and programmes, resulting in better service delivery by governments. According to a research article on access to government information trends, nearly half of African countries lack Freedom of Access to Information laws while most of the existing laws have restrictive clauses, hindering citizens from accessing government information.

As such, it’s time Africa focuses on ensuring the unhindered free flow of information both online and offline rather than failure to adopt and effectively implement access policies. This article discusses the various ways to promote transparency by enhancing information access in Africa. የኢትዮጰያ የካፒታል ገበያ ባለስልጣን በካፒታል ገበያ አዋጅ ቁጥር 1248/2013 ከተሰጡት ስልጣንና ተግባራት መካከል ቁጥጥር ለደረግባቸው የሚገቡ የካፒታል ገበያ ተግባራትን መወሰን፣ ስካIta ገበያ አገልግሎት ሰጪዎች ፈቃደ መስጠት እና ስራቸውንም መቆጣጠር ይ7ኝበታል፡፡

በዚህም መሰረት ባለሰልጣኑ ለካፒታል ገበያ አገልግሎት ሰጪዎች ፈቃድ የሚሰጥበትና የሚቆጣጠርበትን መመሪያ አዘጋጀ±ል፡፡ "phIta ገበያ አገልግሎት ሰጪዎች የፈቃድ አሰጣጥና ቁጥጥር መመሪያ ቁጥር 980/2016" Πλ.6.8.6tC+oon C 9 3 2016 ዓ.ም ጀምሮ ስራ ላይ ውሏል። በዚህም መሠረት ባለስልጣኑ በቅርቡ የአገልግሎት ፈቃድ ማመልከቻዎችን መቀበል ይጀምራል፡፡

ይህን በማስመልከt በዚህ አጭር ጽሁፍ የካፒታል ገበያ አገልግሎት ሰጪዎች ምን ማለት ነው ፣ ምን ምን ተግባራትን ያከናውናሉ፣ ምን አይነት ሀላፊነቶች አስባቸው፣ ፈቃድ ለማግኘትስ ምን አይነት መሰፈርቶችንና መመዘኛዎችን ማሟላት ይጠበቅባቸዋል የሚሉት ጉዳዮች ላይ አጠር ያስ ማብራሪያ ቀርቧል፡፡

የሙና ወንጀሎች አዋጅ ቁጥር 881/2007 አንቀፅ 13 (1) እና (2) ባለማድረግ (Omission) ይልቅ በማድረግ (Comission) የተፈጸመ ወንጀልን ለመቅጣት የተደነገገ ነው።

የሙስና ወንጀሎች አዋጅ ቁጥር 881/2007 አንቀፅ 13(2) በአንቀፅ 13(1) ከፊደል ሀ እሰከ ሐ የተመለከቱን ዝርዝር የህግ ነጥቦች መሰረት በማድረግ የከበደ የወንጀል ሀላፊነትን ለመጣል የተቀመጠ ሲሆን አንቀፅ 13(1) ከፊደል ሀ እስከ ሐ የተመለከቱትን ዝርዝር ሁኔታዎች ጥቅም መውሰድን ወይም ጥቅም የሚያስገኝን ውል መዋዋልን፤ ውል ማቋረጥን፤ የመንግስት ወይም የህዝባዊ ድርጅትን ጥቅም የሚጎዳ ተግባርን መፈፀምን ለመቅጣት የተደነገጉ መሆናቸው አንቀፅ 13 ከመነሻውም ካለማድረግ (Omission) ይልቅ ማድረግን (Comission) ለመቅጣት በህጋችን የተካተተ መሆኑን ያሳያል፡፡

ስለሆነም ተከሳሹ በስራ ሀላፊነቱ መሰረት ሊከታተለውና ሊቆጣጠረው ሲገባ ግዴታውን ባለመወጣት የደረሰ ጉዳት በአዋጁን አንቀፅ 13(2) መሰረት የወንጀል ክስ ከቀረበ የህጉን ዝርዝር ሁኔታ መሰረት ያላደረገ ክስ ነው።
በስራ መዘርዝር መሰረት የመከታተልና የመቆጣጠር ሀላፊነትን ባለመወጣት የሚፈጸም ወንጀል የሚያስጠይቀው በወ/ህ/አ.420(2) መሰረት የስራ ሀላፊነትን ባለመወጣት የወንጀል ድርጊት እንጂ በጸረ-ሙስና አዋጅ ቁጥር 881/2007 አንቀፅ 13(2) አይደለም

የፌደራል መጀመሪያ ደረጃ ምድብ ችሎቶች እና አድራሻቸው

አቤቱቱታ ስለ ማሻሻል - የፍትሐ ብሔር ሥነ-ሥርአት ህግ ቁጥር 91

አቤቱታ ማለት ለፍርድ ቤት የሚቀርብ ክስ/መልስ/ይግባኝ/ወይም ሌላ ማንኛውም አይነት አንድ ባለ ጉዳይ ከፍ/ቤት የሆነ ዳኝነት እንዲወሰንለት በመጠየቅ የሚያቀርበው ማመልከቻ ነው፡፡

አቤቱታ ላይ ያቀረበው ሰው የሚጠየቅው ዳኝነት እና ይህንን ዳኝነት ሊያገኝ የሚገባውን ጉዳይ አብራርቶ መጠየቅ ያለበት ሲሆን ክስ ከቀረበ በኋላ ወይም ጉዳዩ ከጀመረ በኋላ በአቤቱታው ላይ መገለጽ የነበረበት እና አለመገለጹ ባለ ጉዳዩን የሚጎዳ፤ ትክክለኛ ውሳኔ እንዳይሰጥ ሊያደርግ የሚችል እና ለፍትህ አሰጣጥ የሚስቸግር ከሆነ ባለ ጉዳዩ ይህንን አቤቱታ አሻሽሎ ወይም የተጓደለውን አሟልቶ እንዲያቀርብ እንዲፈቀድለት ለፍ/ቤት ሊያመለከት ይቻላል፡፡

አቤቱታ ሲሻሻል ነገሩን በይበልጥ ወይም በተሻለ መንገድ ማብራራት እንጂ በመጀመሪያው ዳኝነት ላይ ያልተጠየቀ እና ፈጽሞ የተለየ ጉዳይ ወይም ዳኝነት ይፈጸምልኝ የሚል ጥያቄ ማቅረብ አይቻልም፡፡

The Ethiopian Institutions of Ombudsman (EIO) leads the implementation of the 2008 Freedom of Expression and Access to Information Proclamation, monitoring progress and ongoing efforts. Additionally, Public Information Noble (PIN) Ethiopia collaborates with IEYA ongoing advocacy to ATI focuses on training, manuals, procedures, and awareness campaigns to address both demand and supply aspects of access to information.

The Alehig/አለሕግ platform is set to contribute significantly by providing searchable databases of Ethiopian laws, cases, and legal resources. It also includes audio files tailored for lawyers with visual impairments, ensuring inclusivity in legal information access.
