Response:
Sheikh Yahya surrendered Dammaj in exchange for preserving the lives and honor of his students in a deal brokered by the official government. The Sheikh and his students left Dammaj with their creed intact, without compromising Al-walaa wal baraa or any other tenets.
Surrendering to the enemy does not remove a person from Salafiyyah, especially when that which was surrendered was merely land and constructions. In fact, if Dammaj fell a hundred times over, its people would still remain upon Salafiyyah.
The fall of Dammaj and its handover to the Houthis is similar to the fall of Dir’iyah (a town of Tawhid) in 1233 AH. The tyrant Bāsha forced its people into migration and killed those he killed, but Tawhid remained.
The sons of Sheikh Muhammad ibn ’Abdul Wahhāb migrated to Egypt, but their grandchildren returned after some time to revive Tawheed.
What were the results of this surrender?
Ahlus-Sunnah spread far and wide and took their Da'wah with them. Through this surrender, Salafiyyah has reached all across Yemen and beyond ولله الحمد والمنة.

'Ihyaa At-Turaath is the cancer of the Salafi Da'wah'
Sheikh Yahya Al-Hajoori hafidhahullah said: “It is a mischievous Jam'iyyah. If one nicknamed it 'the cancer of the [Salafi] Da'wah' they would not be far off. Jam'iyyah Ihyaa At-Turaath and whatever branches off it and is affiliated to it [from the other Jam'iyyaat] is the cancer of the [Salafi] Da'wah and the [Salafi] Du'aat. Whoever enters into it becomes ruined; he dissipates and enters into a state of regression. Yes, he may still give lectures, but it is deprived of any Salafi benefit - not like how he was before. It stupefies people and ruins men by means of wealth.”
[T.N. They cause division between the Du'aat by offering them financial assistance. At first it appears that they are doing this unconditionally for the sake of Allah, but soon after, their plans and real intentions become clear. For example, they say to the daa'ee: We will buy you books, expand your masjid, sponsor your students, allocate salaries for the teachers, etc., but after a while, when they see that the daa'ee is reliant on them financially, they start to stipulate conditions upon him in order to continue assisting him. So those who remain loyal to the Jam'iyyah receive financial assistance, while those who oppose the Jam'iyyah are left with nothing; even if they are more deserving of assistance. Remember, these funds were given to them by generous donors to distribute to charitable causes - but they take advantage by using it to further their own agenda. Through this they have been able to silence many du'aat from speaking the truth and have even turned many of them against the scholars and their fellow Salafi brothers. Furthermore, most of the existing Jam'iyyaat in the Islamic world - if not all of them - were established to serve various political parties and provide funding for them, because these parties are unable to collect Zakah and charity in the name of the party, but it is easy to do so in the name of orphans, widows, spreading knowledge, building masjids. So the Jam'iyyah takes on this role and then spends these funds in the interest of the party and its members. This is why Sheikh Albani rahimahullah would say:
'الجمعيات أستار الحزبيات'
“Jam'iyyaat are act like a smokescreen for Hizbiyyah.” In the same way, Sheikh Muqbil rahimahullah used to say:
'الجمعيات حزبية مغلفة'
“Jam'iyyaat are hidden forms of Hizbiyyah”].

A*dditional contraventions:
[POINT 8] - Every Jam'iyyah has to appoint a chairman, whereas appointing a chairman/ an Ameer while resident (الإمارة في الحضر) is an innovation. The only Ameer during residency is the main Ameer/leader of the Muslims, and the only time where it's allowed to appoint an Ameer (aside from the main Ameer) is when travelling as a group of three or more, as reported by Abu Dawud (2609) on the authority of Abu Hurairah radhiyallahu 'anhu. What's more, some of these Jam'iyyaat request members to pledge allegiance (bay'ah) to the board of directors of the Jam'iyyah.
[POINT 9] - Jam'iyyaat must conform and operate according to man-made laws. They also hold elections to appoint/demote chairmen and trustees, although this may vary from one Jam'iyyah to another.
[POINT 10] - Jam'iyyaat operate with a level of secrecy. For example, they hold secret board meetings between members of the jam'iyyah on a weekly, monthly or annul basis. However, the Prophet ﷺ said:
((عليك بالعلانية وإياك والسر))
“Observe openness and beware of secrecy.” [Sheikh Albani said the chain of transmission is good (jayyid)]
Also, 'Umar radhiyallahu anhu said:
'إذا رأيت قوما يتناجون في دينهم دون العامة فاعلم أنهم في تأسيس ضلالة'.
“If you see people engaging in secret discussions about religious affairs away from the general public, then know that they are laying the foundation of misguidance.” [Reported by Abu Nu'aim in Al-Hilyah (5/338), Al-Laalaka'ee in 'As-Sunnah']
So, da'wah related affairs should be referred to and discussed with the people of knowledge - not in these secret board meetings between chairmen and trustees.

Implications of apostasy (summarised from Sheikh Yahya's "Mukhtaṣar Al-Maqāl"):
The apostate is adviced, requested to repent and return to Islām (الاستتابة), but if they persist upon disbelief they are killed as an apostate
The ties of faith and loyalty between them and the Muslims are completely severed
It is not permissible for them to marry a Muslim
It is not permissible for them to act as a waliyy (guardian) for a Muslim relative in marriage
It is not permissible for them to inherit from a deceased Muslim relative, nor is it permissible for the relative to inherit from them
It is not permissible for them to enter Makkah and the surrounding sanctuary
Their slaughtering is impermissible
Their testimony is invalid
Zakāh is not collected from them nor distributed to them
It is not permissible to offer funeral prayer over them
It is not permissible to pray behind them
It is not permissible to seek forgiveness for them after their death
...
After reflecting over these implications, you can see why declaring a Muslim to be a disbeliever is such a serious issue!
You can also see why abandoning prayer (an act of disbelief) is such a grave sin!!!
We say the act is an act of Kufr, but we do not declare this person to be a Kāfir, nor are the implications of Kufr applicable to him in this Dunya. As for his affair in the Hereafter, then it is with Allāh.
As for one who has the Ḥujjah established on him, but he rejects and persists upon Kufr, then he is not to be excused, but rather he is to be declared a Kāfir.
And we don't say that it's impossible for one to be ignorant in the modern era due to the Internet and spread of social media.
POINT 5. If the Ḥujjah is apparent and manifest; the Qur’ān is recited and the Sunnah can be heard. So the issue is not absence of evidence in that place, but it's carelessness on this person's part.
Hence the excuse of ignorance is not applicable if he guilty of turning away from acquiring/understanding the evidences.
{وَمَنۡ أَظۡلَمُ مِمَّن ذُكِّرَ بِـَٔایَـٰتِ رَبِّهِۦ فَأَعۡرَضَ عَنۡهَا وَنَسِیَ مَا قَدَّمَتۡ یَدَاهُۚ إِنَّا جَعَلۡنَا عَلَىٰ قُلُوبِهِمۡ أَكِنَّةً أَن یَفۡقَهُوهُ وَفِیۤ ءَاذَانِهِمۡ وَقۡرࣰاۖ وَإِن تَدۡعُهُمۡ إِلَى ٱلۡهُدَىٰ فَلَن یَهۡتَدُوۤا۟ إِذًا أَبَدࣰا}
“And who does more wrong than those who, when reminded of their Lord’s revelations, turn away from them and forget what their own hands have done? We have certainly cast veils over their hearts—leaving them unable to comprehend this ˹Quran˺—and deafness in their ears. And if you ˹O Prophet˺ invite them to ˹true˺ guidance, they will never be ˹rightly˺ guided.” [Sūrah Al-Kahf: 57]
POINT 6. The two points of differing amongst Ahlus-Sunnah concerning the issue of العذر بالجهل:
THE FIRST. Is there an ignorant person who has not received proof in this day and age?
We say that the Sharī'ah rulings is suitable for all times and places, and this is an issue that existed before the introduction of these modern means, and we have already stated that: If there is someone who the proof has not yet reached them, the excuse of (العذر بالجهل) applies to him, and Allāh knows best goes on His earth.
THE SECOND (and this is of greater importance and more controversial than the first):
Whoever complies with aspects of Islām while being ignorant of other aspects of it because the proof has not reached him, or it has not been explained to him, or he commits acts of Kufr unknowingly...?
The brothers disagreed concerning the ruling as it relates to this Dunya while being in agreement that in the afterlife his affair is with Allah.
• Some of them said: He has committed Kufr, so he is adjudged to be an apostate, but we excuse him in terms of the penal punishment.
• And some of them said: The act of Kufr was done out of ignorance - not stubbornness, or turning away. So there is no disagreement between us with regards to the action being an act of Kufr; But he is not declared to be Kafir until the Ḥujjah is established against him. Once the Ḥujjah is established, he is declared a Kafir. And this opinion is more correct!
Summary of Sheikh Yaḥya's Mukhtaṣar Al-Maqāl regarding Al-’Udhr bil Jahl
POINT 1. There is no doubt whatsoever concerning those whom Allah has declared to be disbelievers in the Qur'ān, such as the Idolaters, Polytheists, Jews and Christians...
{إِنَّ ٱلَّذِینَ كَفَرُوا۟ مِنۡ أَهۡلِ ٱلۡكِتَـٰبِ وَٱلۡمُشۡرِكِینَ فِی نَارِ جَهَنَّمَ خَـٰلِدِینَ فِیهَاۤۚ أُو۟لَـٰۤئكَ هُمۡ شَرُّ ٱلۡبَرِیَّةِ}
“Those who disbelieve among the People of the Book and the idolaters will have the Fire of Hell, there to remain. They are the worst of creation.” [Sūrah Al-Bayyinah: 6]
POINT 2. "Ahlul Fatrah" are those people who live in the period between two Prophets wherein revelation is discontinued, such as the period between Ēsā عليه السلام and Muḥammad ﷺ.
The ruling of "Ahlul Fatrah" varies:
A. If the message of the previous Prophet reached them and they accepted it, then they are believers; like Zaid ibn ’Amr ibn Nufail and Waraqah ibn Nawfal.
B. If the message of the previous Prophet reached them but they rejected it, they are disbelievers by ijma'; like the Prophet's mother and father.
{وَكُنتُمۡ عَلَىٰ شَفَا حُفۡرَةࣲ مِّنَ ٱلنَّارِ فَأَنقَذَكُم مِّنۡهَا}
“And you were at the brink of a fiery pit and He saved you from it.” [Sūrah Āli-ʿImrān: 103]
قال ابن كثير رحمه الله: "وَكَانُوا عَلَى شَفَا حُفْرة مِنَ النَّارِ بِسَبَبِ كُفْرِهِمْ، فَأَبْعَدَهُمُ اللَّهُ مِنْهَا: أنْ هَدَاهُم لِلْإِيمَانِ."
C. If the message of the previous Prophet did NOT reach them, we refrain from passing Judgement upon them. Rather, their fate will be determined in the Hereafter where they will be tested by Allāh ﷻ; so whoever obeys Him will be admitted to Jannah, and whoever disobeys Him will be admitted to Hellfire.
This category includes:
- The deaf who couldn't hear anything
- The foolish/insane who had no understanding
- The senile
- Those who died in infancy
POINT 3. The one who complies with those aspects of Islam which have reached him, but he falls into major Kufr due to being ignorant of the other aspects of Islam which have not reached him...is this person excused due to ignorance? This is the issue of differing amongst Ahlus-Sunnah!
POINT 4. There are preventatives which stand between declaring someone to be Kāfir. These preventatives have to be taken into consideration in the above case. Such as committing Kufr mistakely; like the man who mistakenly said:
اللهم أنت عبدي وأنا ربك
“O Allāh You are my servant and I am your Lord.”
In the same way, ignorance is a preventative; as proven by:
The ḥadīth concerning the man who told his relatives to burn his body after his death and scatter the ashes out of fear of Allāh. He did this based on his ignorance of Allāh’s capability.
likewise, the ḥadīth concerning the Companions who requested a Dhāt Anwāṭ like that of the Idolaters. They only said this out of ignorance since they had just embraced Islām.
We also have to take into account whether or not the Ḥujjah (evidence) has been established:
{وَمَن یُشَاقِقِ ٱلرَّسُولَ مِنۢ بَعۡدِ مَا تَبَیَّنَ لَهُ ٱلۡهُدَىٰ وَیَتَّبِعۡ غَیۡرَ سَبِیلِ ٱلۡمُؤۡمِنِینَ نُوَلِّهِۦ مَا تَوَلَّىٰ وَنُصۡلِهِۦ جَهَنَّمَۖ وَسَاۤءَتۡ مَصِیرًا}
“And whoever defies the Messenger after guidance has become clear to them and follows a path other than that of the believers, We will let them pursue what they have chosen, then burn them in Hell—what an evil end!” [Sūrah An-Nisāʾ: 115]
Ultimately, this (establishing the Ḥujjah) is the objective of the Prophets & Messengers:
{رُّسُلࣰا مُّبَشِّرِینَ وَمُنذِرِینَ لِئَلَّا یَكُونَ لِلنَّاسِ عَلَى ٱللَّهِ حُجَّةُۢ بَعۡدَ ٱلرُّسُلِ}
“˹All were˺ messengers delivering good news and warnings so humanity should have no excuse before Allah after ˹the coming of˺ the messengers.” [Sūrah An-Nisāʾ: 165]

[المسلك الذي يقوم به شيخنا يحيى الحجوري حفظه الله في كتابه الرياض المستطابة]
قال شيخنا يحيى الحجوري حفظه الله :
والمسلك في هذا عدة مراحل:
المرحلة الأولى : تثبيت صحبة هذا الصاحب المفرد، فإن لم تثبت صحبته لا يصلح إدخاله في صحيح المفاريد؛ لأنه تابعي.
المرحلة الثانية : إثبات أنه ليس له إلا هذا الحديث، في الكتب الستة، ومسند أحمد، أو في سائر الكتب،فإذا كان له أكثر من حديث فإنه لا يصلح إدخاله في المفاريد.
المرحلة الثالثة : أن يكون هذا الحديث صحيحا، أو حسنا، إما لذاته أو لغيره، فلو كان ضعيفا فلا يدخل في صحيح المفاريد، يدخل في الضعيف.
المرحلة الرابعة : شرح هذا المُفرد.
