𝗠𝘆 𝘀𝗵𝗮𝘆𝗸𝗵 𝗰𝗮𝗻 𝘄𝗲𝗶𝗴𝗵 𝗯𝗲𝘁𝘄𝗲𝗲𝗻 𝘁𝗵𝗲 𝗽𝗿𝗼𝘀 𝗮𝗻𝗱 𝗰𝗼𝗻𝘀 𝘄𝗵𝗲𝗻 𝘀𝗶𝘁𝘁𝗶𝗻𝗴 𝗮𝗻𝗱 𝗽𝗮𝗿𝘁𝗮𝗸𝗶𝗻𝗴 𝗶𝗻 𝗰𝗲𝗿𝘁𝗮𝗶𝗻 𝗲𝘃𝗲𝗻𝘁𝘀, 𝗯𝘂𝘁 𝘆𝗼𝘂𝗿 𝘀𝗵𝗮𝘆𝗸𝗵 𝗰𝗮𝗻’𝘁….

The Arabs have a saying:

“You weigh with two weighing machines,
And scale with two scales.”

This proverb means that justice & equality should be the foundation in all matters and issues, & that dealings should be done with fairness and justice without bias or favoritism.

I’ve been meaning to write about this legal Fiqhi maxim and I think now it’s convenient. This is a concept you will find in 𝗯𝗮𝘀𝗶𝗰 books of Qawaaid Al Fiqhiya and incorporated in the books of Fiqh. I have also covered it in my 5 hour video; “𝗖𝗵𝗮𝗹𝗹𝗲𝗻𝗴𝗲𝘀 𝗶𝗻 𝘁𝗵𝗲 𝘀𝗮𝗹𝗮𝗳𝗶 𝗱𝗮𝘄𝗮𝗵”. And “𝟱 𝗹𝗲𝗴𝗮𝗹 𝗺𝗮𝘅𝗶𝗺𝘂𝗺𝘀 𝘁𝗵𝗮𝘁 𝘄𝗶𝗹𝗹 𝗰𝗵𝗮𝗻𝗴𝗲 𝘆𝗼𝘂𝗿 𝗹𝗶𝗳𝗲”

This principle is a 𝗳𝗼𝘂𝗻𝗱𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗰𝗼𝗻𝗰𝗲𝗽𝘁 𝗶𝗻 𝗜𝘀𝗹𝗮𝗺𝗶𝗰 𝗹𝗮𝘄, serving as the cornerstone on which the entire religion is based, as highlighted by Sh Abdulrahman As-sidi in his poem "Al-Qawaid Al-Fiqhiyyah" lines 12-14. It goes beyond specific issues, extending to all aspects of religion and is particularly significant in decision-making processes related to when one is involved in dawah.

Ibn Taymiyyah & Ibn Al Qayim both cited:

"𝗪𝗵𝗲𝗻 𝘁𝗵𝗲 𝗽𝗿𝗼𝘀 & 𝗵𝗮𝗿𝗺𝘀 𝗰𝗼𝗻𝗳𝗹𝗶𝗰𝘁, 𝘁𝗵𝗮𝘁 𝘄𝗵𝗶𝗰𝗵 𝗼𝘂𝘁𝘄𝗲𝗶𝗴𝗵𝘀 𝗮𝗻𝗱 𝗽𝗿𝗲𝘃𝗮𝗶𝗹𝘀 𝘁𝗵𝗲 𝗼𝘁𝗵𝗲𝗿 𝗺𝘂𝘀𝘁 𝗯𝗲 𝗳𝗮𝘃𝗼𝗿𝗲𝗱”

Majmu' al-Fatawa, I'lam al-Muwaqqi'in

Taj al-Din al-Subki also cited in Ashbaah wal-Nadhaa'ir:
“𝗣𝗿𝗶𝗼𝗿𝗶𝘁𝗶𝘀𝗶𝗻𝗴 𝘁𝗵𝗲 𝗽𝗿𝗲𝘃𝗲𝗻𝘁𝗶𝗼𝗻 𝗼𝗳 𝗵𝗮𝗿𝗺𝘀 over the pursuit of benefits in cases of conflict occurs 𝗼𝗻𝗹𝘆 𝘄𝗵𝗲𝗻 𝘁𝗵𝗲 𝗹𝗲𝘃𝗲𝗹𝘀 𝗼𝗳 𝗯𝗲𝗻𝗲𝗳𝗶𝘁 𝗮𝗻𝗱 𝗵𝗮𝗿𝗺 𝗮𝗿𝗲 𝗲𝗾𝘂𝗮𝗹.”

Imam Al-Shatibi in his Muwafaqaat likewise said:

"One May have to engage in a Prohibition when there is a prevalent outweighing benefit."

Meaning, 𝗪𝗵𝗲𝗻 𝗳𝗮𝗰𝗲𝗱 𝘄𝗶𝘁𝗵 𝗮 𝘀𝗶𝘁𝘂𝗮𝘁𝗶𝗼𝗻 𝘄𝗵𝗲𝗿𝗲 𝘁𝗵𝗲 𝗯𝗲𝗻𝗲𝗳𝗶𝘁𝘀 𝗼𝘂𝘁𝘄𝗲𝗶𝗴𝗵 𝘁𝗵𝗲 𝗵𝗮𝗿𝗺𝘀, 𝗮𝗻𝗱 𝗶𝘁 𝗶𝘀 𝗻𝗼𝘁 𝗽𝗼𝘀𝘀𝗶𝗯𝗹𝗲 𝘁𝗼 𝗰𝗼𝗺𝗽𝗹𝗲𝘁𝗲𝗹𝘆 𝗲𝗿𝗮𝗱𝗶𝗰𝗮𝘁𝗲 𝘁𝗵𝗲 𝗱𝗶𝘀𝗮𝗱𝘃𝗮𝗻𝘁𝗮𝗴𝗲𝘀, 𝗼𝗻𝗲 𝘀𝗵𝗼𝘂𝗹𝗱 𝗻𝗼𝘁 𝗱𝗶𝘀𝗿𝗲𝗴𝗮𝗿𝗱 𝘁𝗵𝗲 𝗯𝗲𝗻𝗲𝗳𝗶𝘁𝘀 𝘀𝗼𝗹𝗲𝗹𝘆 𝗱𝘂𝗲 𝘁𝗼 𝘁𝗵𝗲 𝗲𝘅𝗶𝘀𝘁𝗲𝗻𝗰𝗲 𝗼𝗳 𝘀𝗼𝗺𝗲 𝗼𝗳 𝘁𝗵𝗲𝘀𝗲 𝗵𝗮𝗿𝗺𝘀 & 𝗱𝗶𝘀𝗮𝗱𝘃𝗮𝗻𝘁𝗮𝗴𝗲𝘀.

Likewise If the 𝗵𝗮𝗿𝗺𝘀 𝗮𝗻𝗱 𝗯𝗲𝗻𝗲𝗳𝗶𝘁𝘀 𝗮𝗿𝗲 𝗲𝗾𝘂𝗮𝗹 𝗮𝗻𝗱 𝗯𝗮𝗹𝗮𝗻𝗰𝗲𝗱 at a ratio of 50/50, the 𝗽𝗿𝗶𝗼𝗿𝗶𝘁𝗶𝘀𝗮𝘁𝗶𝗼𝗻 should lean towards preventing & eradicating the harm, therefore not engaging in it, as averting harm takes precedence over acquiring benefits when they are at a deadlock.

𝗜 𝗵𝗮𝘃𝗲 𝗰𝗼𝗻𝘀𝗶𝘀𝘁𝗲𝗻𝘁𝗹𝘆 𝗲𝗺𝗽𝗵𝗮𝘀𝗶𝘇𝗲𝗱 𝘁𝗵𝗮𝘁 𝗯𝗲𝗶𝗻𝗴 𝘀𝗲𝗲𝗻 𝘄𝗶𝘁𝗵 𝗮𝗻𝗼𝘁𝗵𝗲𝗿 𝗽𝗲𝗿𝘀𝗼𝗻 𝗼𝗿 𝗶𝗻 𝗮 𝗽𝗵𝗼𝘁𝗼𝗴𝗿𝗮𝗽𝗵 is 𝗺𝗼𝗿𝗲 𝗻𝘂𝗮𝗻𝗰𝗲𝗱 than what meets the eye. There could be numerous explanations for why they were together.

In my view, the situation is trivial & lamentable, as online discussions have become contentious. I recognise that many are frustrated with inconsistencies and contradictions, leading them to retaliate with similar behavior, not because they believe it to be wrong or a proof, but to give one a dose of his own medicine. If one understood these principles, he wouldn’t have a heart attack upon seeing a picture!

To conclude, 𝗶𝘁’𝘀 𝘄𝗼𝗻𝗱𝗲𝗿𝗳𝘂𝗹 𝘁𝗼 𝘀𝗲𝗲 𝘁𝗵𝗮𝘁 𝘁𝗵𝗲 𝗻𝗮𝗿𝗿𝗼𝘄 𝗺𝗶𝗻𝗱𝗲𝗱, 𝗿𝗶𝗴𝗶𝗱 𝗮𝗻𝗱 𝗶𝗻𝗳𝗹𝗲𝘅𝗶𝗯𝗹𝗲 𝗮𝗿𝗲 𝘀𝗵𝗼𝘄𝗶𝗻𝗴 𝘀𝗶𝗴𝗻𝘀 𝗼𝗳 𝗴𝗿𝗼𝘄𝘁𝗵 & 𝗺𝗮𝘁𝘂𝗿𝗶𝘁𝘆, we see them now all of a sudden giving their shaykhs the benefit of the doubt, 𝗹𝗲𝘁’𝘀 𝘀𝗮𝘃𝗲 𝘁𝗵𝗲 𝘀𝗮𝗺𝗲 𝗲𝗻𝗲𝗿𝗴𝘆 𝗳𝗼𝗿 𝗼𝘁𝗵𝗲𝗿𝘀 𝘄𝗵𝗲𝗻 𝘁𝗵𝗲𝘆 𝗺𝗮𝗸𝗲 𝘀𝗶𝗺𝗶𝗹𝗮𝗿 𝗱𝗲𝗰𝗶𝘀𝗶𝗼𝗻𝘀 or when they may come together with others due to 𝗰𝗼𝗺𝗺𝗼𝗻 𝗰𝗵𝗮𝗹𝗹𝗲𝗻𝗴𝗲𝘀 𝘁𝗵𝗮𝘁 𝘁𝗵𝗲𝘆 𝗳𝗮𝗰𝗲 𝗮𝘀 𝗠𝘂𝘀𝗹𝗶𝗺𝘀 𝗮𝘀 𝗮 𝘄𝗵𝗼𝗹𝗲.
