Dear Nick you recall that the major charges against me of Incitement were dropped years ago by the Prosecution. In my opinion because they had no evidence, and I had elected to take the charges to trial by jury in the County Court jurisdiction.

Thus the current trial was about 2 remaining relatively trivial charges:

1. Posting on facebook in contravention of my conditions of bail (not to contravene a Commonwealth or State Law); and

2. Publishing my police record of interview by posting it to my facebook account.

Concerning 1 above, the Magistrate was very sympathetic but stuck to his ruling that a law is a law is a law and it is not his job to investigate if the law is a good law or a bad law. This needs to be done in another judicial jurisdiction, eg. Administrative Law jurisdiction.

This ruling by the Magistrate relates to our submission that the pre-conditions of the PHWA have not been met (ie. there was no Emergency), and thus the PHWA is not a Commonwealth or State Law.

In addition, the Magistrate refused our argument that publishing a comment by a Facebook user was not inciteful and was harmless and fully within the Commonwealth Constitution, allowing Public Free Speech.

Concerning 2 above, the Magistrate refused our argument that under Section 322K of the Crimes Act, I acted in self-defense for myself and all Victorian people.

So after 4 years and probably a couple of million dollars of taxpayers money spent by the Victorian Government on this, in my opinion, farce, I received a 'slap on the wrist' of a fine of $250 and a good behaviour bond of 18 months, and if I'm a 'good boy' no Criminal conviction.

We will certainly continue the legal fight for Justice for all Victorians and Australians.

One possible way forward is using VCAT as a potential administrative Tribunal to investigate the PHWA.

Another way is to use the Crime and Corruption Commission, proving fraud by the Victorian Government, in not fulfilling the preconditions of the Act.
