*?* Laura Codruța Kovesi, the former head of the National Anticorruption Directorate (DNA), the current Prosecutor General of the European Public Prosecutor's Office, has escaped from the case in which she was prosecuted for constituting an organized criminal group and complicity to unjust repression, due to prescription, ȘtiripeSurse reports.
Kovesi was accused, among other charges, of having induced a chief prosecutor to confirm an unlawful indictment that sent five people to trial and is being prosecuted for constituting an organized criminal group and for five counts of complicity to unjust repression in the form of improper participation, according to Realitatea PLUS.
Prosecutor Mihai-Eduard Ilie of the General Prosecutor's Office has closed the case in which the former Section for the Investigation of Crimes against the Judiciary (SIIJ) had started criminal proceedings against former DNA chief Laura Kovesi - currently the head of the European Public Prosecutor's Office - for the crimes of constituting an organized criminal group in the coordination modality and complicity to unjust repression in the form of improper participation. This investigation was related to the way in which DNA indicted the former Prosecutor General of the Prosecutor's Office of the Ploiești Court of Appeal, Liviu Tudose, together with the former Deputy Prosecutor of the Ploiești Court of Appeal, Aurelian Mihăilă, former MP Sebastian Ghiță, former head of the IPJ Prahova, Viorel Dosaru, and former head of the DGA Prahova, Constantin Ispas, all of whom were acquitted by the High Court.
The prosecutors of the Section for the Investigation of Crimes against the Judiciary (SIIJ) - disbanded in the meantime at the pressure of the Coldea Network and Clan - announced in March 2019, in a press release, that they had ordered the prosecution of Laura Codruța Kovesi for the establishment of an organized criminal group and five crimes of complicity to unjust repression in the form of improper participation. She was accused of having coordinated the criminal group initiated by two prosecutors and a judicial police officer in 2015-2016, through the work carried out, orders and dispositions given.
The Section for the Investigation of Magistrates alleged that three other prosecutors and another judicial police officer joined this group, acting in coordination to commit the offenses of abusive investigation, unjust repression, influencing statements, misleading judicial bodies, intellectual forgery and use of forgery.
The special section prosecutors say that the orders and provisions in question include a circular in which Kovesi allegedly allowed the same person to be heard as both a witness with a protected identity and a witness with a real identity during the criminal proceedings. Furthermore, an order on uniform practices in the administration of audio/video evidence at the level of the National Anticorruption Directorate allegedly violated Art. 143 para. 2 and 4 of the Code of Criminal Procedure, because it allowed the transmission to the courts only of the media with the relevant conversations.
By her conduct as a hierarchical prosecutor, Kovesi allegedly induced a chief prosecutor to confirm, without guilt, an unlawful and unreasonable indictment, ignoring the reports of the prosecutors in charge of the DNA - Central Structure. As a result, five people were indicted, although four prosecutors had indicated in writing that this was not necessary, according to the source. All were acquitted after years of trials.
