📣 Press Statement

New Delhi, February 13, 2025

It is unfortunate that the Waqf Amendment Bill was presented in the parliament today. The way the ruling party, its allies and the Joint Parliamentary Committee (JPC) have completely ignored the stance and opinions of Indian Muslims, views of opposition members within the JPC and have unilaterally pushed their arbitrary proposal in parliament through an undemocratic process is highly condemnable. This is completely unacceptable to Indian Muslims, other minorities and all justice-loving citizens.

We believe that the government still has an opportunity to withdraw this bill, which poses a direct threat to Waqf properties and aims to deprive Muslims of their mosques, eidgahs, madrasas, dargahs and graveyards etc. This is the wayfor the government to act responsibly and uphold its stated commitment;Sabka Saath, Sabka Vikaas.

Muslims across India, including scholars from various sects, religious and community organizations, prominent madrasas and intellectuals have collectively opposed this bill. Crores of Muslims have submitted their objections via email, presenting well-reasoned arguments. In matters of this nature, the opinions of the affected stakeholders hold paramount importance, as this is a fundamental democratic principle. However, these voices have been completely ignored.

This is a fact that the government’s stance on Muslim-related issues has been consistently biased, discriminatory and hostile—an approach that is not only irresponsible but also it is a direct violation of constitutional values and protections. We urge all opposition parties and even the ruling BJP’s allies to ensure that this bill is not passed in the parliament. Likewise, we appeal to Indian civil society, justice-lovingcitizens, defenders of democracy and advocates of constitutional, religious, and cultural rights to reject this draconian bill.If this divisive bill is passed, it will not only affect the Muslims but will also set a dangerous precedent against all the endowments of other religious communities, places of worship and charitable institutions.
We make it clear that if the bill is passed, we will not accept it under any circumstances. We will pursue all peaceful, legal and democratic options in collaboration with justice-loving, patrioticcitizens and religious groups until this unjust law is repealed.

Another alarming move by the ruling party is the Uttarakhand government’s enforcement of the Uniform Civil Code (UCC). Following this, the Gujarat government has also formed a committee to draft UCC in its state. We categorically state that no state has the authority to enforce UCC on its own. Article 44 of the Indian Constitution assigns this matter to the central government which is not mandatory and subject to the consent of all communities and religious groups.

We strongly oppose the Uttarakhand government's imposition of this flawed, unnecessary and religiously biased law, which is nothing more than an anti-Muslim and replication of Western cultures. All India Muslim Personal Law Board (AIMPLB)will challenge this so-called UCC in court and launch a united movement against it with all religious communities.

We call upon the Muslims of Uttarakhand to remain steadfast in adhering to Shariat and to uphold their faith with patience.

अफ़सोस कि आज वक़्फ़ संशोधन बिल राज्यसभा में भी पेश कर दिया गया। जिस तरह इस मामले में सत्तारूढ़ पार्टी, उसकी सहयोगी पार्टियाँ और संसद की स्थायी समिति ने भारतीय मुसलमानों के विचार और राय को निरंतर नजरअंदाज करके बिल्कुल गैर-लोकतांत्रिक तरीके से अपना मनमाना प्रस्ताव संसद में पेश किया है, वह अत्यधिक निंदनीय है और भारतीय मुसलमानों, अल्पसंख्यकों और सभी न्यायप्रिय लोगों के लिए अस्वीकार्य है और हम इसे खारिज करते हैं। हम समझते हैं कि सरकार के लिए अभी भी मौका है कि वह इस संशोधन बिल को जो पूरी तरह से वक्फ़ की संपत्तियों को नष्ट करने वाला और मुसलमानों को उनकी मस्जिदों, ईदगाहों, मदरसों, दरगाहों और कब्रिस्तानों की जमीनों से वंचित करने वाला है, वापस लेकर एक जिम्मेदार और “सबका साथ सबका विकास” के अपने नारे पर अमल करे।

देश के कोने-कोने में मौजूद मुसलमानों के सभी मत, धार्मिक और राष्ट्रीय संगठन, प्रमुख धार्मिक मदरसे और विद्वानों ने स्थायी समिति से मिलकर और लगभग 5 करोड़ मुसलमानों ने ईमेल द्वारा बिल की मुखालफत में जोरदार और तर्कपूर्ण अंदाज में अपनी राय दी थी। जाहिर है इस तरह के मामलों और समस्याओं में संबंधित समूहों (stakeholders) की राय की ही विशेष अहमियत होती है और यही लोकतांत्रिक अपेक्षा भी है, लेकिन इसे बिल्कुल ही नजरअंदाज कर दिया गया। यह एक सच्चाई है कि मुसलमानों से संबंधित सभी मामलों में वर्तमान सरकार का रुख अत्यंत पक्षपातपूर्ण, पूर्वाग्रहपूर्ण और विरोधी है जो न केवल गैर-जिम्मेदाराना है बल्कि संविधानिक मूल्यों और सुरक्षा के भी खिलाफ है। हमारी विपक्ष की सभी राजनीतिक पार्टियों और भाजपा की सहयोगी पार्टियों से अपील है कि वह इस बिल को किसी भी सूरत में संसद से पारित न होने दें। इसी तरह हम देश के नागरिक समाज और सभी न्यायप्रिय, लोकतंत्र समर्थक, संविधानिक, धार्मिक और सांस्कृतिक स्वतंत्रता और विविधता में विश्वास रखने वाले नागरिकों से अपील करते हैं कि वे इस अत्याचारपूर्ण और दमनकारी बिल को हरगिज भी पारित न होने दें। आज अगर भेदभाव से भरा यह बिल पारित हो गया तो आगे चलकर दूसरे तबकों और समूहों की वक्फ़ संपत्तियाँ, उपासना स्थल और धर्मार्थ संस्थान भी इस अत्याचारपूर्ण रुख की चपेट में आने से बच नहीं सकेंगे।

हम यह स्पष्ट कर देना चाहते हैं कि अगर यह बिल संसद से पारित हो गया तो हमारे लिए हरगिज़ भी स्वीकार्य नहीं होगा। हम देश के सभी न्यायप्रिय लोगों और देशप्रेमी नागरिकों, धार्मिक वर्गों और समूहों को साथ लेकर इसके खिलाफ शांतिपूर्ण तरीके से सभी कानूनी और लोकतांत्रिक रास्तों को अपनाते हुए उस समय तक आंदोलन चलाएँगे जब तक कि यह अत्याचारपूर्ण कानून वापस नहीं ले लिया जाता।

सत्तारूढ़ पार्टी का एक और अत्याचारपूर्ण कदम उत्तराखंड सरकार द्वारा उत्तराखंड में समान नागरिक संहिता का लागू करना है। इसी की नकल में अब गुजरात सरकार ने भी एक समिति बनाकर अपने राज्य में भी समान नागरिक संहिता के लागू करने का संकेत दिया है। सबसे पहले हम यह स्पष्ट कर देना चाहते हैं कि देश के किसी भी राज्य को अपने तौर पर समान नागरिक संहिता लागू करने का अधिकार नहीं है। देश के संविधान ने अनुच्छेद 44 में यह अधिकार केंद्रीय सरकार को दिया है और वह भी वैकल्पिक है और सभी वर्गों और धार्मिक इकाइयों की रज़ामंदी के तहत है। हम उत्तराखंड सरकार द्वारा लागू इस ग़लत, गैर-जरूरी और धार्मिक पूर्वाग्रहों पर आधारित, मुस्लिम विरोधी कथित समान नागरिक संहिता कानून को कानूनी तौर पर अदालत में चुनौती देने के साथ-साथ सभी धार्मिक समूहों को साथ लेकर इसके खिलाफ आंदोलन चलाएँगे। हम उत्तराखंड के मुसलमानों से उम्मीद करते हैं कि वे हर हाल में सिर्फ और सिर्फ शरिया कानून पर ही अमल करेंगे और धैर्य और सहनशीलता के साथ अपने धर्म पर कायम रहेंगे।
